A1. Who we are
In these terms, “we”, “us” and “our” means Lesjo Pty Ltd (ABN 75 166 007 156) trading as Town of 1770 Golf Course and Driving Range, of 2366 Round Hill Road, Agnes Water QLD 4677. “You” means anyone who visits the venue, plays golf, uses the driving range or the Hole in One Challenge, hires equipment, attends a function, or uses our website.
A2. When these terms apply
These terms apply whenever you enter the venue, buy or book anything from us, or use our website. Activity-specific terms, such as the Hole in One Challenge terms in Part B, also apply to those activities. If an activity-specific term conflicts with these general terms, the activity-specific term applies to that activity.
Functions, weddings and memberships may have their own written agreement. Where they do, that agreement applies alongside these terms.
A3. Your rights under consumer law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law, or under any other law, that cannot lawfully be excluded, restricted or changed. Every other clause in these terms is read subject to this clause.
A4. Prices and payment
• Prices are in Australian dollars and include GST.
• Prices are shown on our website and at the clubhouse. We may change prices from time to time, but a change does not affect anything you have already paid for.
• We do not charge a surcharge for paying by card.
• Member prices are available only to current financial members, who may be asked to show proof of membership.
A5. Weather, closures and refunds
• We may close the course, the range or any activity, or stop play, if weather, lightning, heat, ground conditions, maintenance or safety make it unsafe or unsuitable to continue.
• If we close or stop an activity you have paid for before you have had a reasonable opportunity to use it, we will offer you a refund for the unused portion, or a credit to use on another day, at your choice.
• If you choose to stop playing for your own reasons, we are not required to refund you, but you keep any rights you have under the Australian Consumer Law.
• If you are removed from the venue under clause A8, we will refund any unused portion of what you paid, less any amount needed to cover damage you caused.
A6. Course, range and cart rules
• Follow staff instructions, posted signs and the house rules in Part C at all times.
• Play only from the tees, fairways and range bays provided. Do not enter the range landing area or any area marked out of bounds.
• Golf carts may only be driven by a person aged 25 or over who holds a current driver licence. Carts must be driven on paths and in areas shown by staff, with no more than two people on board. You are responsible for damage to a cart caused by careless or reckless use.
• Normal golf etiquette applies, including letting faster groups through and repairing divots and pitch marks.
• Neat, casual dress is required to enter the golf course including enclosed footwear at all times, no thongs, sandals or bare feet
A7. Children
Children are welcome. A child under 18 must be accompanied and supervised at all times by a responsible adult, who is responsible for the child’s behaviour and safety. Children under 8 years are not permitted in the range bays or at the Hole in One tee.
A8. Safety and conduct
Golf is played outdoors on natural ground. Risks include being struck by a ball or club, slips and trips on uneven or wet ground, sun and heat, insects, snakes and other wildlife, including kangaroos on the course. Please take care, wear suitable footwear, use sun protection and drink water.
We may refuse entry, stop your participation or ask you to leave if we reasonably believe that you:
• are acting unsafely or putting yourself or others at risk
• appear to be affected by alcohol or drugs
• are abusive, threatening or disruptive towards staff or other guests
• are damaging or misusing equipment or the course
• are not following staff instructions, these terms or the house rules.
A9. Alcohol
Alcohol is supplied and consumed only in accordance with our liquor licence and the Liquor Act 1992 (Qld). We will not serve anyone who is under 18 or who appears to be unduly intoxicated. Alcohol must not be taken onto the range tee or the Hole in One tee.
A10. Equipment and hire
Hire equipment, carts and range equipment must be used only for their intended purpose and returned in the same condition, allowing for fair wear and tear. Tell staff straight away if anything is damaged or not working. You may be asked to pay the reasonable cost of repair or replacement if equipment is lost or damaged through careless, reckless or deliberate misuse.
A11. Liability
Recreational services. The golf course, driving range and Hole in One Challenge are recreational services. To the extent permitted by section 139A of the Competition and Consumer Act 2010 (Cth), our liability for a failure to comply with a consumer guarantee in sections 60 or 61 of the Australian Consumer Law, that causes death, physical or mental injury, or the contraction or aggravation of a disease, is excluded. This exclusion does not apply to significant personal injury caused by our reckless conduct.
Other loss. To the extent permitted by law, we are not liable for indirect or consequential loss, such as travel or accommodation costs, arising from a closure, delay or change to an activity for reasons outside our reasonable control.
Our responsibility. We take reasonable care to keep the venue safe. Nothing in this clause limits our liability for our own fraud or reckless conduct, or any liability that cannot lawfully be limited.
A12. Personal belongings
Please keep valuables with you or secure. We are not responsible for loss of, or damage to, personal belongings, unless it is caused by our negligence or a failure to meet a consumer guarantee.
A13. Photos and cameras
• We may take photos or video at the venue for promotion. If you do not want to be photographed or filmed, tell a staff member and we will respect that.
• We will not publish an identifiable image of a child without the consent of their parent or guardian.
• Where security cameras operate, signs will say so. Cameras record images only, not audio. Footage is used only for safety, security and verifying prize claims, and is kept for no longer than 30 days unless it is needed for a claim, incident or dispute.
A14. Privacy
We handle personal information as described in our privacy collection notice (Part D) and in accordance with the Privacy Act 1988 (Cth) and the Spam Act 2003 (Cth).
A15. Competitions, prizes and promotions
Competitions, prizes and promotions have their own terms, which are displayed on site or on our website. The Hole in One Challenge terms are in Part B.
A16. Changes to these terms
We may update these terms from time to time, for example to reflect a change in the law or in what we offer. The version published on our website when you visit or pay is the version that applies to that visit or payment. A change will not apply to anything you have already paid for.
A17. Questions and complaints
If you have a question or complaint, speak to a staff member or contact us at [email protected]] or 07 4974 9663. We will try to resolve it within 14 days. You may also contact the Queensland Office of Fair Trading.
These terms are governed by the law of Queensland.
